The business migration section of the “Asylum and Immigration” law comes into force as of March 1st.

This Act enhances France’s ability to attract foreign talents, who contribute not only to our economic drive, but also to linguistic and cultural influence of France.

Key points :

  • The “Talent Passport” residence permit is extended to employees of a company officially recognized as innovative by the Minister of Economy via the “French Tech Visa for Employees” procedure.
  • Holders of a long-stay visa bearing the mention “Talent Passport” will now be able to travel while their residence permit application is being processed by the Prefecture of their place of residence in France, thanks to the issuance of a Temporary Residence Permit (Autorisation Provisoire de Séjour – APS).
  • Minor children of the spouse of an individual who holds a “Talent Passport” or an “Intra-corporate transfer (ICT)” permit have now have access to the simplified “accompanying family” procedure. An additional simplification measure will be the issuance of a single travel document for minors (DCEM).
  • A temporary “Job seeking and company setup” residence permit comes into force. This new residence permit enables students who have obtained a Masters-level qualification in France and who have left the country to return to France for professional purposes within a maximum period of four years after graduation.
  • Foreign intra-corporate transferees applying for an « ICT resident permit » (or “ICT trainee” in the event of an internship or training) will need to reside outside the EU when submitting their application and prove a seniority of at least six months in the group of companies (compared with three months previously).

Changes to international service provisions will enter into force in 2020

By Order, the Directive revising the original European legal framework applicable to posted workers has been transposed into French law.

With a focus on protecting workers and cooperation on fraud and abuse, the Order published on 20 February 2019 strengthens the current legislative and regulatory framework for posting of workers, emphasising greater transparency and endorsing the principle of “equal work, equal pay“.
